Our firm represents small and mid-size companies in various corporate and commercial litigation
matters. Although there are multiple factors to consider when selecting an attorney, here are three
key factors that we have learned are vital to keep in mind.
First and foremost, look for an aggressive and experienced attorney that will not only fight for you but
has the know-how and the savvy to achieve the desired result. This doesn’t always mean hiring the
loudest, meanest, desk-pounding attorney. The best attorneys know when to be aggressive and
when to use other means when dealing with the judge and other attorneys. Find an attorney with a
well thought out approach, someone that is using all of the tools (namely, the law) at their disposal.
Good strategy takes into account knowing the judge’s tendencies, the county that you are in, the
opposing attorney, and of course the legal issues at hand. Simply put, the right attorney for you is
strategically aggressive.
Second, look for an efficient attorney that understands the bottom line. It goes without saying that
too many attorneys engage in numerous, unnecessary steps in litigation that only serve to pad their
bills. It is vital to find an attorney that understands the litigation process from start to finish –
someone that can tell you at the outset that steps X, Y, and Z would be needless expenses. Also,
there is the business reality of the expenses related to litigation. A good attorney respects this fact
and takes every proper step to minimize fees.
Third, and maybe most important, look for an attorney that will give you personal attention and make
the effort to obtain a deep understanding of your company and/or your case. An attorney can better
represent you if he knows the intricacies of your company and fully understands you personally. A
key part of this personal relationship with your attorney is an open, honest, and respectful
relationship. You must find an attorney that is willing to speak truth to power. The best attorneys
are not afraid to tell their clients when they are wrong and should choose an alternate course of
action. This type of counsel is essential for you to maximize your chances of success in litigation.
